Tate County Circuit Court
Tate County Circuit Court records show the following sentences were among those handed down during the January 2023 Vacation terms of court.
According to court records, the following decisions were handed down in Judge Jimmy McClure’s court:
• Cassius Clay Black, of Horn Lake, had his probation revoked to serve five years in MDOC to run concurrently with previous sentencing on a charge of conspiracy. He must pay $1,996.83 in court costs.
• Tracy Gene Brannon, of Sarah, had his probation revoked to serve three years in MDOC on a charge of possession of a firearm by a convicted felon. He must pay $2,057.41 in court costs.
• Tracy Gene Brannon, of Sarah, had his probation revoked to serve nine years and 132 days in MDOC on a charge of possession of a firearm by a convicted felon as a habitual offender. He must pay $1,924.06 in court costs.
• Jamarcus Burton, of Sardis, was sentenced to 34 days in MDOC and four years, 328 days post-release supervision after a guilty plea on a charge of possession of stolen firearm. He must pay $16.80 in court costs.
• Joe Lee Conley, of Senatobia, had his probation revoked to serve 10 years in MDOC on a charge of fondling. He must pay $1,660.59 in court costs.
• Marty Allen Houston, of Sarah, was sentenced to five years non-adjudication after a guilty plea on a charge of possession of controlled substance – methamphetamine, two to 10 dosage units. He must pay $1,633.90 in court costs.
• Marshall Moore Jr., of Como, was sentenced to 20 years in Mississippi Department of Corrections (MDOC) after a guilty plea on a charge of manslaughter. He had a charge of conspiracy remanded to the file. Moore must pay $3,652.70 in court costs.
• John Howard Starkey Jr., of Nesbit, was sentenced to 133 days in MDOC and four years, 232 days post-release supervision in intervention court after a guilty plea on a charge of failure to register as a sex offender as a habitual offender. He must pay $2,161.50 in court costs.
According to court records, the following decisions were handed down in Judge Smith Murphey’s court:
• Eric Bradford Mays, of Coldwater, had his probation revoked to serve three years in MDOC on a charge of possession of marijuana with intent to sell with firearm enhancement. He must pay $88.80 in court costs.
• Dustin Michael Robertson, of Coldwater, was sentenced to three years in MDOC and two years post-release supervision to run consecutively with previous sentencing after a guilty plea on a charge of possession of stolen property. He must pay $1,563.50 in court costs.
• Lawrence Christopher Walker, of Niles, Ohio, was sentenced to five years non-adjudication after a guilty plea on a charge of receiving stolen property. He had a charge of conspiracy remanded to the file. Walker must pay $1,803.50 in court costs.
Some of the final decisions reported here may be the result of plea negotiations. By law, circuit court judges are not involved in plea negotiations. Most sentences are the result of a negotiated agreement between the district attorney and defendant.
